PREAMBLE

These General Terms and Conditions relate to the use of the following website:

  • The public area of the Website for each User designated as any natural person who accesses the Website without requiring identification and without access to the Applicant portal.
  • The Applicant portal for each Applicant designated as any natural person who has created a user account on the Website to apply for job offers offered by Henner

Use of the website and/or the services it provides is subject to unconditional acceptance by the User and/or Applicant of these General Terms and Conditions.

2. PURPOSE OF THE WEBSITE

The website allows the User and/or Applicant to:

  • Search and consult the job offers offered by Henner,
  • Apply for the job offers proposed by Henner or send an unsolicited application by creating a user account
  • Create a user account on the Website to manage information and applications

3. WEBSITE ACCESS CONDITIONS AND PROCEDURE

Henner cannot in any way guarantee a seamless service free of any computer defects or bugs. In particular, it may at any time:

  • suspend, interrupt or limit access to all or part of the Website, reserve access to the Website or to certain parts of the Website to a category of User and/or Applicant, 
  • change, modify or suspend access to the Website for maintenance reasons such as updates, or for any other legitimate reason.

Henner will endeavour to notify the User and/or Applicant if the Website becomes unavailable, by any appropriate means and in particular by posting on the home page of the Website.

The unavailability of the Website cannot in any way engage Henner's responsibility and does not give any right to compensation for the benefit of the User and/or Applicant.

4. APPLICANT PORTAL CONDITIONS AND PROCEDURE

       4.1 Access to the Applicant Portal and responsibility of the Applicant

The Applicant Portal is accessed with a username (email) and a password chosen by the Applicant when creating their account on the Website. The password must comply with the security rules and levels defined by Henner. The Applicant will then receive an email confirming registration.

The password must be regularly renewed by the Applicant in the Applicant Portal, in the "change password" section. The password is strictly personal and non-transferrable. Applicants are responsible for keeping their password confidential. They must therefore take all reasonable measures to keep it secret and assume entire responsibility for the outcome if communicated to others. Thus, Henner will not assume responsibility for any damage caused by fraudulent use of the Applicant Portal.

If the password is forgotten, the Applicant ask Henner to reset it on the sign-in page of the Applicant Portal. To do so, the applicant clicks on the forgotten password tab and enters an email address. An email is then sent to the Applicant with a link to the password reset page and where the password can be changed. An email confirming the change of password is sent to the Applicant.

Access to the Applicant Portal is fully secured, which ensures that the information provided when performing certain tasks online remains confidential.

The Applicant uses the Applicant Portal under his/her own responsibility. The Applicant guarantees Henner that he/she is the only one to access the data stored in the Applicant Portal.

In the event of unauthorised use of the Applicant's account, the Applicant undertakes to notify Henner immediately.

The Applicant is responsible for the content of data entered in the Applicant Portal. The Applicant guarantees that the content is truthful, and that it does not infringe the rights of third parties, the law, public order or morality.

Henner reserves the right to exercise any recourse against the Applicant if these conditions are violated. In particular, Henner reserves the right to suspend or delete the Applicant's user account or to initiate legal proceedings.

      4.2 Services offered on the Applicant Portal

  • The Applicant Portal allows the Applicant to: 
    • complete/modify/update their information (contact details, professional experience, languages) and documents (CV, cover letter or other recommendations)
    •  create targeted alerts generating notifications of new job offers corresponding to the criteria he/she has defined
    • Possibility to request the deletion of his/her data

        4.3 Account deletion

The Applicant can delete their account from the Applicant Portal at any time in the menu provided for this purpose when signed into the Applicant Portal. The Applicant receives and email confirming the deletion of the account.

The Applicant's account is also deleted after one year of creating the account.

5. PERSONAL DATA PROTECTION AND COOKIES

Henner undertakes, within the framework of its activities and in accordance with the French and European provisions in force, to ensure the best level of protection, confidentiality and security of the Users' and/or Applicants’ personal data and to protect their privacy to its best ability.

For any information on the protection of personal data and the use of cookies by Henner, the User and/or Applicant can consult the Henner Privacy Policy accessible here or from a link provided at the bottom of each page of the Website.

6. INTELLECTUAL PROPERTY RIGHTS

       6.1 Literary and artistic property

The User and/or Applicant is informed that all illustrations, drawings, photographs, presentations, texts, source codes, and more generally, any content appearing on the Website are the exclusive property of Henner and/or affiliated companies and are protected by intellectual property law.

The User and/or Applicant must refrain from the following, without Henner’s prior written consent and subject to civil and penal sanctions:

  • reproduce or have reproduced the various components of the Website, in whole or in part, temporarily or permanently, in any manner whatsoever, on any medium, any format, by any process, known or unknown to date,
  • represent or have represented the various components of the Website, in whole or in part, in any way whatsoever, by any process, any mode of dissemination, any mode of communication known or unknown to date,
  • adapt or have adapted the various components of the Website, in whole or in part, temporarily or permanently, and in particular to translate into any language the various components of the Website, to create any derivative work, to produce new versions or developments from components of the Website, to maintain, modify, arrange, assemble, digitise all or part of the various components of the Website.

This rule applies in all countries for the duration of the protection provided for by the intellectual property law, and for all types of use, free of charge or against payment.

        6.2 Distinctive brands and signs

All brands mentioned on the Website are filed with the French Industrial Property Institute, INPI, and as such are duly protected. The names of companies, products and services and any other distinctive signs mentioned on the Website remain the property of and the fruit of efforts and investment of Henner and/or its affiliated companies, and as such are duly protected. Their usurpation is strictly prohibited, and their possible use is subject to the prior written agreement of Henner, subject to civil and penal sanctions.

7. HENNER’S LIABILITY

In no case may Henner be held liable for damage suffered by the User and/or Applicant linked to:

  • an interruption of the Website independent of its will, or to a case of force majeure generating an interruption or malfunction of the Website,
  • an exceptional and time-limited interruption of the Website, necessary for carrying out a maintenance operation or improving its functionality,
  • any incident or interruption of the Website caused by a malfunction and/or inadequacy of the User and/or Applicant's equipment, hardware and/or software and infrastructure,
  • any financial loss, loss of clientele, commercial disturbance, loss of programs or data resulting from the use of the Website,
  • the unauthorised penetration of a third party into the User and/or Applicant's computer system leading to the dissemination of harmful software,
  • to a connection or consultation of the Website in countries where this use constitutes a violation of applicable laws or regulations,
  • any inconvenience or damage inherent in the use of the Internet, in particular in the event of a failure, breakdown, difficulty or interruption of operation preventing access to the Website and/or to one of its functions.

8. TECHNICAL PREREQUISITES

This Website was created in responsive web design mode on modern browsers such as MOZILLA FIREFOX (3.6 and above), GOOGLE CHROME, MICROSOFT INTERNET EXPLORER (IE8 and above), EDGE and SAFARI.

9. CHANGES TO THE GENERAL TERMS AND CONDITIONS

Henner reserves the right to modify these General Terms and Conditions of Use at any time, depending on the modifications made to the Website, the settings and in particular the technical prerequisites, developments of legislation or for any other legitimate reason.

We therefore advise Users and/or Applicants to consult the Website regularly for any amendments that may have been made. The User and/or Applicant can determine the date on which Henner made the last modifications by referring to the “Latest update” indicated above.

10. HYPERTEXT LINKS

Any information accessible via a hypertext link to other websites is not under the control of Henner, which declines any responsibility for their content.

The introduction by the User of any hypertext links to all or part of the Website is strictly prohibited without prior written authorisation from Henner, requested by email to the following email address: info@henner.fr. Henner may refuse the User and/or Applicant's request without having to justify its decision. If it authorises hypertext links, this authorisation will be temporary and may be withdrawn at any time, without specific reason and without the User and/or Applicant being able to claim an acquired right.  In all cases, the link must be removed at Henner’s request.

11. APPLICABLE LAW AND JURISDICTION

These General terms and conditions are subject to French law. In cases of dispute which cannot be resolved amicably, the only jurisdiction applicable are the French courts.
